Terms of Use Agreement

User Agreement Introduction:

Our online store welcomes you and informs you that you will find below the terms and conditions that govern your use of this store and all legal implications that result from your use of the store's services through the internet via this electronic platform. By using the store—whether as a consumer of a service or product or otherwise—you express your full acceptance and agreement, being legally competent under Sharia, system, and law, to all terms and provisions of this agreement. This also confirms your commitment to comply with the regulations mentioned herein. This agreement applies to all types of interactions between the consumer and the store. It becomes valid and effective once you agree to it and begin registering in the store, in accordance with Article Ten of the Saudi Electronic Transactions Law.

Article One – Introduction and Definitions:

The above preamble is considered an integral part of this agreement. Below are the meanings and definitions of the main terms used in this agreement:

Store: This includes all forms of the store on the internet, whether it’s an electronic app, a website, or a physical store.
Consumer: The person engaging in e-commerce to obtain the products or services provided by the store through its electronic platform.
Agreement: This refers to the terms and conditions of this agreement that govern the relationship between the parties to the agreement.

Article Two – Consumer’s Legal Capacity:

The consumer acknowledges that they possess the legal capacity, under Sharia and law, to deal with the store, or that they are at least 18 years old.
The consumer agrees that in case of violating this article, they will bear the consequences of such a violation towards others.

Article Three – Nature of Obligation:

The store’s obligation towards consumers is to provide the (service or product).
The store may offer additional services such as after-sales services, depending on the nature and type of (service or product) requested by the consumer.

Article Four – Usage Regulations:

The consumer is committed to using the store’s platform in accordance with public morals and the laws applicable in the Kingdom of Saudi Arabia.
The consumer agrees not to use any purchased service or product from the store in any manner that violates public morals or applicable laws in the Kingdom of Saudi Arabia.

Article Five – Accounts and Registration Obligations:

By applying for membership in the store, you agree to disclose specific information and choose a username and password to use when accessing the store’s services. Accordingly, you agree to:

Be responsible for maintaining the confidentiality of your account and password, and agree to notify the store immediately of any unauthorized use of your account or any breach of your confidential information.
The store is not liable for any direct or indirect loss—material or moral—resulting from the disclosure of your username or password.
Use your account personally and take full responsibility for it. If someone else uses it, it’s assumed you have authorized them to do so on your behalf.
Use the store seriously and honestly.
Provide true, accurate, updated, and legal information about yourself during registration and update it if there are any changes.
The store is committed to keeping your personal information and contact details strictly confidential.
If it becomes clear that you provided false, incorrect, outdated, or incomplete or illegal information or violated the agreement, the store has the right to suspend, freeze, or cancel your membership or account without affecting its right to pursue legal action or protect other consumers.
If any of the above is not followed, the store’s management has the right to suspend or cancel your account or ban you from accessing its services.

Article Six – Electronic Communication and Official Channels:

The parties agree that communication will be via the email registered in the platform.
The consumer agrees that all agreements, notices, disclosures, and communications provided electronically will have the same legal standing as written ones.
The consumer agrees that the store may contact or notify them through general messages sent to all or specific users.

Article Seven – Modifications to Terms and Fees:

If any article or clause in this agreement becomes void or unenforceable, this does not affect the validity of the rest of the agreement.
This agreement, which may be amended from time to time, forms the mechanism of operation and understanding between the store and the consumer.
The store may impose fees on some consumers depending on the requested products, services, promotions, or government-imposed taxes.
The store reserves the right to add, increase, reduce, or waive any fees or expenses according to the terms of this agreement for any consumer regardless of the reason for their registration.

Article Eight – Payment and Billing Services:

The store provides payment services via its partners. Payments can be fully processed online using available payment options or any other method provided by the store from time to time.
The store is committed to setting prices according to the recognized market value.
The store must provide invoices, receipts, and acknowledgments for all received payments, and give the consumer a purchase invoice.
The store must comply with recognized accounting standards in its platform as per this agreement and related regulatory, economic, and commercial interests.

Article Nine – Intellectual Property:

All intellectual property rights related to the store are fully owned by the store, whether established before or after launching the platform.
The consumer agrees to respect the store’s intellectual property rights, including the store name, words, slogans, and other elements, all of which are fully owned by the store.

Article Ten – Store Liability:

The store is committed to conducting its business through this platform lawfully and in accordance with Saudi regulations and this agreement.
The store is not liable for claims arising from errors or negligence—whether directly or indirectly—from the consumer or third parties like shipping companies.
The store and its representatives ensure that the (product or service) is legitimate and approved under Saudi law for lawful use.

Article Eleven – Access or Membership Restriction:

The store may suspend, cancel, or limit a consumer’s access to the platform at any time and without prior notice, for any reason.

Article Twelve – Governing Law:

This agreement is governed by and interpreted according to the laws and regulations of the Kingdom of Saudi Arabia, and is subject entirely to the applicable authorities in the Kingdom.

Article Thirteen – General Provisions:

If any part of this agreement becomes invalid or unenforceable, this does not affect the validity of the remaining provisions, which remain in effect until further notice from the store’s management.

This user agreement, which may be amended from time to time, forms the working and contractual understanding between the store and the consumer. Both parties also agree to the following:

Arabic is the official language for interpreting and translating this agreement.
All prices displayed on the store’s services or products are subject to change.
Promotional or marketing offers by the store are temporary and may be changed or canceled at any time.
The parties agree to deal with each other in accordance with Sharia principles, applicable laws, and the nature of their dealings.
This agreement may only be terminated by a decision from the store’s management.
